Terms of Service

1. About these terms

These Terms of Service (the "Terms") apply to AppraisalGPT, a service operated by CMAGPT ("we", "us", "our"), and to your use of the website at appraisalgpt.co.uk and any related services, applications or reports (together, the "Service"). "You" and "your" mean the person or business that creates an account or uses the Service.

By creating an account, starting a subscription or using the Service, you agree to these Terms. If you use the Service on behalf of an agency or other business, you confirm that you are authorised to accept these Terms for it, and "you" includes that business.

2. Business use only

The Service is a professional tool for estate agents, letting agents, valuers and other property professionals, and is provided for use in the course of a trade, business or profession. It is not offered to consumers. By subscribing you confirm that you are acting for purposes relating to your trade, business or profession. Accordingly, consumer cancellation rights (such as the 14-day cooling-off period for distance contracts) do not apply.

3. The Service

AppraisalGPT helps you prepare market appraisals. For a property you search, it retrieves recent sold prices and other property information from public and licensed sources, scores comparable sales, applies adjustments, and uses artificial intelligence to draft a written appraisal report that you can review, edit and export.

Features available to you depend on your plan. Plan features, search allowances and prices are shown on the Pricing page at the time you subscribe, and form part of your subscription.

4. A market appraisal is not a valuation

Reports produced by the Service are market appraisals: an informed opinion of the likely selling price to support your own professional judgement. They are nota RICS valuation, a "Red Book" valuation, a mortgage or lending valuation, a survey or a structural inspection, and they must not be presented as any of these.

You remain responsible for:

  • checking the property facts used in a report (floor area, property type, bedrooms, tenure and so on) and correcting them where they are wrong;
  • the price advice you give to your clients, and any asking price, guide price or offer advice you publish or recommend;
  • complying with the law and codes that apply to you, including consumer protection law, material information requirements and any redress scheme or professional body you belong to;
  • deciding whether a report is suitable to share with a client.

5. Data sources

The Service uses public and licensed data, including HM Land Registry Price Paid Data, energy performance certificate records, house price index figures, postcode and boundary data, flood and planning information, and map and street imagery. This data comes from third parties and may be incomplete, out of date or wrong. For example, a sale can take weeks or months to appear in the Land Registry record, and an energy performance certificate can predate later extensions or alterations. We do not guarantee the accuracy or completeness of any data, and you should verify anything you rely on.

6. AI-generated content

Parts of every report are written by artificial intelligence. AI-generated text can contain errors, omissions or statements that do not fit a particular property. Figures in reports are calculated from the comparable data and adjustments, but the data behind them can still be wrong. Review every report before you use it or share it.

7. Your account

You must be at least 18 years old to use the Service. Keep your sign-in details secure and do not share your account; you are responsible for activity under it. Tell us through the Support page if you think your account has been used without your permission.

8. Acceptable use

You must not:

  • use the Service unlawfully, or to mislead buyers, sellers, landlords or tenants;
  • scrape, bulk-download or resell data or reports from the Service, or use it to build a competing data product;
  • attempt to access the Service by automated means, bypass usage limits, or interfere with its security or operation;
  • upload content you do not have the right to use, or that is unlawful.

We may suspend or end your access if you breach this section.

9. Subscriptions, prices and VAT

Subscriptions are billed in pounds sterling, monthly or yearly in advance, through our payment processor, Stripe. Prices are shown exclusive of VAT. VAT and any other applicable taxes are added at checkout where they apply, depending on your location and any VAT number you provide. Your subscription renews automatically at the end of each billing period until you cancel it.

You can cancel at any time from the account area of the Site. Cancellation takes effect at the end of the current billing period: you keep full access until then and are not charged again. Deleting your account does not cancel your subscription, so cancel the subscription first if you intend to leave.

We may change our prices or plans. A price change for an existing subscription will apply from your next renewal after we have given you notice, and you can cancel before it takes effect.

If a payment fails we may suspend access to paid features until it is resolved.

10. Refunds

Because the Service is available for the whole of each paid period, payments are non-refundable, including for unused searches or the unused part of a billing period, except where the law requires otherwise or where we decide to issue a refund at our discretion.

11. Your content and reports

You keep ownership of the information you enter into the Service (such as property details, notes and edits). You grant us a licence to use it to provide and improve the Service. Subject to these Terms and the rights of our data providers, you may use, edit and share the reports you create for your own business, including with your clients.

The Service itself, including its software, design, scoring methods and the AppraisalGPT name, belongs to us or our licensors. Nothing in these Terms transfers those rights to you.

12. Availability

We aim to keep the Service available and working well, but we do not promise that it will be uninterrupted or error-free. We may change, add or remove features, and some features depend on third party services that may change or become unavailable.

13. Liability

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by law.

Subject to that, we are not liable for any loss of profits, revenue, business, instructions, goodwill or data, or for any indirect or consequential loss, however it arises. We are not liable for losses arising from your reliance on a report, from pricing decisions made by you or your clients, or from errors in third-party data.

Subject to the first paragraph of this section, our total liability to you in connection with the Service in any 12-month period is limited to the subscription fees you paid us in that period.

14. Indemnity

You will compensate us for claims, losses and reasonable costs we incur because of your breach of these Terms or your use of a report in your business, including advice you give to your clients.

15. Suspension and termination

You can stop using the Service and cancel your subscription at any time. We may suspend or end your access if you materially breach these Terms, if required by law, or if we stop offering the Service in the UK; if we end the Service for reasons other than your breach, we will give you reasonable notice. Sections that by their nature should continue after termination (including sections 4, 5, 6, 13 and 14) will continue.

16. Personal data

How we handle personal data is described in our Privacy Policy. Where reports include personal data about other people (for example a seller's name in a cover letter), you are responsible for having a lawful basis to use it.

17. Changes to these terms

We may update these Terms from time to time. We will show the date of the latest version at the top of this page and, for material changes, give you notice before they take effect. If you continue to use the Service after a change takes effect, the updated Terms apply.

19. Governing law

These Terms and any dispute arising from them, including non-contractual disputes, are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
